Study Edge

General: 

By accessing, browsing, and/or using this website ("site") and the Study Edge service, or mobile applications ("collectively, "Study Edge"), you agree to be bound by these terms of use ("terms"). You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or guardian’s permission. Please review them carefully before using this site, service, and applications. We reserve the right, at our sole discretion, to change, modify, add or delete portions of these terms and post the changes to this page, including an effective date. Your continued use of this site or the Study Edge applications/service after such changes constitutes your acceptance of the new terms. If you do not agree to abide by these or future terms, please do not use the Study Edge site, service, or applications.  

Definitions: 

The "site" and "service" shall mean the Study Edge website and mobile applications or software accessible via the internet or an Android OS operating system or Apple iOS operating system and mobile network by Study Edge in order to offer services related to the process of viewing educational videos, and any upgrades from time to time and any other software or documentation which enables the use of the site, service, or applications. 

Data Protection and Privacy: 

Any personal information you supply to Study Edge when using the site will be used by Study Edge in accordance with our Privacy Notice. 

Conditions of Use: 

You agree that you may not use the Study Edge site or service in any unlawful manner or in any manner that could damage, disable, overburden or impair the Study Edge site or service. In addition, you agree not to use the Study Edge site, service or applications to post, transmit or make available any content that may be deemed harmful, threatening, abusive, vulgar, discriminatory, harassing or otherwise objectionable. You further agree not to use or attempt to use another user account without our authorization, or to misrepresent yourself on the site or service. You agree that you will not upload or transmit copyrighted, confidential or proprietary information without required authorization or to make available any material that contains software viruses or malicious/destructive computer code. You agree not to share the services you have paid for with anyone else and you will only utilize services for courses you are enrolled in. You agree you will not forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Study Edge Application. 

You will not attempt to copy, reduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the site, service, software, or applications, or create derivative works of any kind from the service and applications, including but not limited to video and PDF content. 

If you access the Study Edge service or applications via a mobile network, you acknowledge that the terms of agreement with your respective mobile network provider will continue to apply when using the application. If you are not the bill payer for the mobile telephone or device used to access the application, you are assumed to have permission from the bill payer to use the application. 

User Content and Profile Information: 

By submitting any information through the Application, you represent and warrant that all such information is accurate, complete, lawful, and current. You are solely responsible for the form, content, and truthfulness of the information you provide, including any details contained in your profile. We disclaim any liability for, and are not obligated to verify, the accuracy or legality of user-submitted content. 

Recurring Billing: 

Your Study Edge membership will automatically be renewed on a month-to-month basis until you cancel. To avoid being charged for the next billing cycle, you must cancel your membership before the renewal date. At the start of each billing cycle, your account will receive the number of tokens included with your selected membership level. Unused tokens will not roll over to future billing cycles. 

Cancellation: 

In order to cancel your membership, go to the My Account page on the Study Edge website, then “Billing” and click "Cancel". Make sure you complete all steps in the cancellation process. You will receive a cancellation confirmation number and email when the process is complete. 

Refunds: 

PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. At any time, and for any reason, we may provide a refund, discount, or other considerations to some or all of our members ("credits"). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstances. 

Availability: 

This site, service and related applications are available via an internet connection or an Android OS or Apple iOS operating system and mobile network. Study Edge will use reasonable efforts to make the site available at all times. You acknowledge the site and service are provided over the internet and/or mobile networks, and the quality and availability of the site may be affected by factors outside of Study Edge's reasonable control. 

Study Edge does not accept any responsibility whatsoever for unavailability of the site or any difficulty or inability to access content or any other communication system failure which may result in the site or service being unavailable. Study Edge makes no warranty that the site, service, content, in-person reviews attended, videos, or results obtained from the service will be accurate, reliable or meet your expectations, or that errors will be corrected. 

Termination: 

Study Edge may terminate use of this site or service at any time by giving notice of termination to you. Upon any termination, all rights granted to you herein shall terminate, and you must cease all use of the site and software. 

Indemnification:  

You will indemnify and hold Study Edge, its parents, subsidiaries, affiliates, officers, and employees harmless (including, without limitation, from all damages, liabilities, settlements, costs and attorneys' fees) from any claim or demand made by any third party due to or arising out of your access to the Service, use of the Service, your violation of this Agreement, or the infringement by you or any third party using your account of any intellectual property or other right of any person or entity. 

Limitation of Liability: 

UNDER NO LEGAL THEORY, INCLUDING, BUT NOT LIMITED TO NEGLIGENCE, SHALL STUDY EDGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, COST OF COVER, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF STUDY EDGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM (i) THIS AGREEMENT; (ii) YOUR USE OR THE INABILITY TO USE THE STUDY EDGE OFFERINGS; OR (iii) ANY INTERACTION WITH ANY THIRD-PARTY THROUGH OR IN CONNECTION WITH STUDY EDGE OFFERINGS, INCLUDING OTHER USERS. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. 

YOU SPECIFICALLY ACKNOWLEDGE THAT COMPANY SHALL NOT BE LIABLE FOR CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. 

CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF YOU RESIDE IN SUCH A JURISDICTION, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS. IN SUCH CASES, COMPANY'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. 

Study Edge is not liable to you for any damage or alteration to your equipment including but not limited to computer equipment, handheld devices or mobile telephones as a result of the browsing or use of the site or service. 

Disclaimer of Warranties: 

To the maximum extent permitted by law, Study Edge disclaims all implied warranties with regard to this site and service, including loss, liability, injury, claim or damage of any kind. The site, service, applications and software are provided "as is" and "as available" without a warranty of any kind. 

Proprietary Rights: 

This site, service and applications and all trademarks, copyright, database rights and other intellectual property rights of any nature in the site, service or applications, together with the underlying software code are owned by Study Edge. No material in any shape or form may be copied, reproduced, transmitted, or distributed.
